These terms are the agreement between you and Lava Factory LLC for using Balance Widget — the app and this website. They are written to be read. By using Balance Widget you accept them; if you don't, don't use it.

1Who we are

Balance Widget ("we", "us") is operated by Lava Factory LLC. These terms cover the app on iPhone, iPad, and Mac, and this website. Your privacy is covered separately by the privacy policy, which is part of this agreement by reference.

2What Balance Widget is — and isn't

Balance Widget reads your bank account balances, with your consent, and displays them as native widgets and inside the app. That is all it does. It is not a financial institution and provides no banking, deposit, payment, or transaction services.

3Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to use Balance Widget for your own use, subject to these terms and, on the App Store, to Apple's Licensed Application End User Licence Agreement (see section 11). You may not sublicense, resell, or redistribute the app.

4Ownership and intellectual property

Balance Widget, including the app, this website, and all software, designs, text, and marks in them, is owned by Lava Factory LLC and its licensors and is protected by intellectual-property law. Except for the limited licence in section 3, we reserve all rights. Nothing in these terms transfers any ownership to you, and you gain no right to our name, logo, or branding.

5Eligibility and your account

You must be at least 18 to use Balance Widget. You are responsible for keeping access to your account secure and for the activity that happens under it. Tell us at support@lavafactory.com if you believe your account has been compromised.

6Connecting a bank

When you link a financial institution, you do so through Plaid. You sign in to your bank inside Plaid's flow, directly with your institution — we never receive or store your bank credentials. You authorise us to retrieve, through Plaid, the account and balance information the app needs to work. The access is read-only and you can revoke it at any time by unlinking the account in the app. How that data is handled is set out in the privacy policy.

7Accuracy of balances

Balances come from your bank through Plaid, and they can be delayed, cached, or temporarily unavailable. Plaid typically refreshes an account's balance about once a day, and an institution can be slow, down, or return stale figures. The number Balance Widget shows is therefore an indication, not an authoritative statement of your balance.

8Acceptable use

You agree not to:

• reverse engineer, decompile, or attempt to extract source code, except where the law expressly permits it;
• access accounts or data that are not yours, or attempt to defeat the app's security or access controls;
• use the app to break the law, or to infringe anyone's rights;
• interfere with, overload, or disrupt the service or its infrastructure.

9Paid features

Balance Widget may offer paid features or subscription tiers. If and when it does, they are sold and billed through the Apple App Store under Apple's terms — we never see your card. Price, billing period, and what each tier includes are shown at the point of purchase. Auto-renewing subscriptions renew until cancelled; you manage and cancel them in your App Store account settings, and Apple's refund policy applies. We will not charge you for a paid feature without showing you the price first.

10Third-party services

Balance Widget relies on third parties to work — chiefly Plaid for the bank connection and Apple for distribution and payments. Your use of those services is also governed by their own terms, including Plaid's end-user agreements. We are not responsible for third-party services we do not control, though we choose them with care and name them plainly in the privacy policy.

11App Store terms

For the version installed from Apple's App Store, you acknowledge that:

• this agreement is between you and Lava Factory LLC only, not with Apple, and Apple is not responsible for the app or its content;
• Apple has no obligation to provide maintenance or support for the app;
• if the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation for the app;
• Lava Factory LLC, not Apple, is responsible for addressing any claim that the app or your use of it infringes intellectual-property rights, and for product-liability, legal-compliance, and consumer-protection claims relating to the app;
• you represent that you are not located in, and will not use the app from, a country subject to a U.S. Government embargo or designated by the U.S. Government as "terrorist-supporting", and that you are not on any U.S. Government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

You can stop using Balance Widget at any time — unlink your banks and delete your account from inside the app, or write to us. We may suspend or end your access if you materially breach these terms or use the app in a way that risks harm to you, to us, or to others. Any provision that by its nature should survive termination — including sections 4, 7, 8, 11, 12, 13, and 17 — does survive.

15General terms

Entire agreement. These terms and the privacy policy are the entire agreement between you and Lava Factory LLC regarding Balance Widget, and supersede any prior understandings, including marketing statements about the app.

Severability. If any provision of these terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining terms will stay in full force and effect.

No waiver. If we do not enforce a right under these terms, that is not a waiver of it.

Assignment. You may not assign these terms. We may assign them to an affiliate, or in connection with a merger, acquisition, or sale of assets.

Force majeure. We are not liable for failure or delay caused by events beyond our reasonable control, including outages at your bank, Plaid, Apple, or our hosting providers.

Electronic communications. You agree that we may communicate with you about Balance Widget by email or in-app notice, and that those communications satisfy any legal requirement that they be in writing.

Feedback. If you send us suggestions or feedback, you grant us a perpetual, royalty-free licence to use them without obligation to you.

16Changes to these terms

We'll update these terms as the app changes, and the effective date at the top will change with them. If a change materially affects your rights, we'll tell you in the app or by email before it takes effect rather than quietly editing the page. Continuing to use Balance Widget after a change means you accept it.

17Governing law

These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-laws rules, except where mandatory consumer-protection law in your place of residence says otherwise. The state and federal courts located in Virginia have exclusive jurisdiction over any dispute, subject to the same exception.
